Această politică descrie modul în care BIRSAN DANIEL AUTOMATIONS S.R.L. prelucrează datele cu caracter personal ale vizitatorilor site-ului bdautomations.ro: la consultarea paginilor, la trimiterea formularului de cerere, la cererea unei demonstrații pe site-ul firmei și la utilizarea asistentului din chat.

Cererile și întrebările privind prelucrarea datelor se trimit la bda@bdautomations.ro și sunt soluționate de societate.
Societatea nu a desemnat un responsabil cu protecția datelor și nu are această obligație: nu prelucrează date pe scară largă, nu prelucrează date din categorii speciale în această activitate și nu monitorizează sistematic persoane.
Prelucrarea se realizează potrivit Regulamentului (UE) 2016/679 (GDPR) și Legii nr. 190/2018. Politica se aplică site-ului. Datele pe care o firmă client le încredințează societății în cadrul serviciului sunt reglementate de Contractul de prelucrare a datelor: https://bdautomations.ro/prelucrarea-datelor.

Datele din formular și din conversația cu asistentul sunt furnizate voluntar. Furnizarea lor nu este obligatorie, însă în lipsa unui nume, a denumirii firmei și a unui mijloc de contact cererea nu poate primi răspuns.
Adresa IP nu este stocată. Se păstrează numai un hash calculat cu o valoare aleatoare, generată din nou la fiecare pornire a serverului; hash-urile nu pot fi comparate între reporniri și nu permit revenirea la adresă.
Formularul conține un câmp ascuns, pe care un vizitator nu îl completează, destinat identificării trimiterilor automate. Când acest câmp este completat, mesajul este respins și nu se salvează nimic.
Datele nu sunt folosite pentru publicitate, nu sunt vândute și nu sunt comunicate altor persoane în afara destinatarilor enumerați mai jos.
Datele salvate în browser
Site-ul nu utilizează cookie-uri. În dispozitivul vizitatorului sunt salvate cinci valori: tema, limba, confirmarea că anunțul privind datele salvate a fost închis, alegerea de a opri măsurarea anonimă a traficului și identificatorul conversației din chat. Fiecare dintre ele este descrisă în Politica de cookie-uri: https://bdautomations.ro/cookie-uri.
Pentru aceste valori, Directiva 2002/58/CE, transpusă în România prin Legea nr. 506/2004, nu impune obținerea consimțământului: ele sunt strict necesare furnizării serviciului solicitat sau sunt salvate ca urmare a unei acțiuni exprese a vizitatorului.

Asistentul transmite mesaje către Anthropic PBC numai atunci când este configurat cu o cheie de API. În lipsa cheii, răspunsurile provin dintr-un set de răspunsuri scrise în prealabil, care rulează pe serverul societății, iar conținutul conversației nu părăsește acest server.
Conținutul introdus în fereastra de chat ajunge la furnizorul de model. Nu se introduc acolo date sensibile, date privind alte persoane, date de card sau parole.
Datele pot fi comunicate autorităților publice atunci când o obligație legală impune aceasta. În rest, accesul la baza de date îl are o singură persoană: fondatorul societății.
Transferuri în afara Uniunii Europene
Serverul, baza de date și copiile de siguranță se află în Uniunea Europeană. Conținutul conversațiilor din chat este transmis către Anthropic PBC, în Statele Unite, atunci când asistentul este configurat cu o cheie de API. Paginile publice citite pentru demonstrația pe site-ul firmei și mesajele scrise în demonstrație sunt transmise, la fel, către Anthropic PBC, în Statele Unite.
Transferul se întemeiază pe clauzele contractuale standard adoptate de Comisia Europeană și pe termenii de prelucrare a datelor ai furnizorului. Dacă furnizorul de email ales prelucrează datele în afara Uniunii Europene, transferul are același temei. O copie a acestor garanții poate fi solicitată la bda@bdautomations.ro.
Durata de păstrare
- Cererile primite prin formular și conversațiile cu asistentul: 24 de luni de la ultimul contact. Ștergerea se face automat: serverul verifică zilnic și elimină definitiv ce a depășit termenul.
- Demonstrația pe site-ul firmei: cererea, 24 de luni de la ultimul contact; mesajele din demonstrație, până la expirarea ei, la 24 de ore după ce este gata; datele publice citite de pe site-ul firmei, 30 de zile, iar telefonul și emailul pe care le publică, trecute în lista internă de firme alături de cerere, cât cererea.
- Jurnalele serverului: atât cât le păstrează furnizorul de găzduire, în mod obișnuit circa 30 de zile.
- Contoarele anonime de trafic: nelimitat, întrucât nu constituie date cu caracter personal.
- Documentele păstrate în temeiul unei obligații legale: termenele prevăzute de lege.
La cerere, datele sunt șterse înainte de împlinirea acestor termene, cu excepția celor a căror păstrare este impusă de lege.
Drepturile persoanei vizate
Persoana vizată are următoarele drepturi:
- acces: obținerea confirmării că datele sunt prelucrate și a unei copii a acestora;
- rectificare: corectarea datelor inexacte și completarea celor incomplete;
- ștergere: eliminarea datelor, atunci când nu există un motiv legal pentru păstrarea lor;
- restricționare: suspendarea prelucrării pe durata verificării unei contestații;
- opoziție: opoziția față de prelucrarea întemeiată pe interesul legitim, inclusiv față de păstrarea conversației din chat;
- portabilitate: primirea datelor furnizate, într-un format structurat, utilizat în mod curent și care poate fi citit automat.
Cererile se trimit la bda@bdautomations.ro și primesc răspuns în termen de o lună de la primire. Pentru cererile complexe, termenul poate fi prelungit cu două luni, cu informarea persoanei vizate, potrivit articolului 12 din GDPR. Exercitarea drepturilor este gratuită.
Pentru a evita comunicarea datelor către o altă persoană, societatea poate solicita confirmarea identității, de exemplu prin răspuns de la adresa de email folosită în corespondența anterioară.
Prelucrarea nu se întemeiază pe consimțământ, astfel încât nu există un consimțământ care să poată fi retras. Alegerile salvate în browser pot fi modificate oricând din site.
Reclamații
Orice nemulțumire privind prelucrarea datelor poate fi adresată societății, la bda@bdautomations.ro. Persoana vizată are dreptul de a depune o plângere la autoritatea de supraveghere:

Persoana vizată se poate adresa și instanțelor de judecată competente.
Decizii automate și profilare
Societatea nu ia decizii bazate exclusiv pe prelucrarea automată care să producă efecte juridice asupra persoanei vizate sau să o afecteze în mod similar semnificativ și nu efectuează profilare. Asistentul formulează răspunsuri cu ajutorul unui model de limbaj, dar nu evaluează, nu clasifică și nu respinge persoane.
Minori
Site-ul se adresează firmelor și persoanelor care le reprezintă. Nu este destinat minorilor sub 16 ani, iar societatea nu colectează cu bună știință date privind aceste persoane. Dacă un părinte sau un reprezentant legal constată că un minor a transmis date, acestea se șterg la sesizarea trimisă la bda@bdautomations.ro.
Securitatea prelucrării
Măsurile aplicate sunt următoarele:
- Traficul dintre browser și server este criptat (HTTPS).
- Paginile sunt servite cu o politică de securitate a conținutului, iar fonturile sunt găzduite pe serverul societății, astfel încât cererile vizitatorilor nu ajung la o rețea externă de distribuție a fonturilor.
- Panoul de administrare este protejat prin parolă și nu este indexat de motoarele de căutare.
- Sunt colectate strict câmpurile necesare pentru soluționarea cererii.
- Adresa IP se păstrează exclusiv sub formă de hash cu sare; adresa în clar nu este scrisă nicăieri.
- Formularul, demonstrația, asistentul și contorul de vizite au limite de utilizare, iar formularele au un câmp ascuns care oprește trimiterile automate.
- Baza de date are copii de siguranță.
- Accesul la date îl are o singură persoană: fondatorul societății.
Societatea nu deține certificări de securitate și nu invocă standarde pe care nu le aplică. Niciun sistem nu este perfect sigur. O încălcare a securității datelor este notificată autorității de supraveghere potrivit articolului 33 din GDPR, iar persoanele vizate sunt informate potrivit articolului 34, atunci când încălcarea prezintă un risc ridicat pentru drepturile lor.
Utilizarea unui sistem de inteligență artificială
Asistentul din fereastra de chat este un sistem de inteligență artificială, nu o persoană, iar răspunsurile sunt generate automat. Informarea vizitatorului cu privire la acest fapt este cerută de Regulamentul (UE) 2024/1689, articolul 50, și este făcută în primul mesaj al asistentului, prin prezenta politică și prin Termeni și condiții. Asistentul din demonstrația pe site-ul firmei se prezintă la fel, ca asistent virtual, din primul mesaj. Comunicarea cu o persoană este disponibilă oricând la bda@bdautomations.ro.
Modificarea politicii
Versiunea aplicabilă este cea publicată pe această pagină, cu data actualizării indicată dedesubt. O modificare importantă, precum apariția unui nou destinatar al datelor, este semnalată pe pagina de start înainte de a produce efecte.

Requests and questions about the processing of data are sent to bda@bdautomations.ro and are handled by the company.
The company has not appointed a data protection officer and is not required to do so: it does not process data on a large scale, it processes no special categories of data in this activity and it does not systematically monitor people.
The processing is carried out under Regulation (EU) 2016/679 (GDPR) and Romanian Law 190/2018. This policy covers the website. Data a client company entrusts to the company as part of the service is governed by the Data processing agreement: https://bdautomations.ro/prelucrarea-datelor.

The data in the form and in the conversation with the assistant is provided voluntarily. Providing it is not compulsory, but without a name, a company name and a means of contact a request cannot be answered.
The IP address is not stored. Only a hash is kept, computed with a random value that is generated again at every server start; the hashes cannot be compared across restarts and do not allow the address to be recovered.
The form contains a hidden field, which a visitor does not fill in, intended to identify automated submissions. When that field is filled in, the message is rejected and nothing is stored.
The data is not used for advertising, is not sold and is not disclosed to anyone other than the recipients listed below.
Data stored in the browser
The site sets no cookies. Five values are stored on the visitor's device: the theme, the language, the confirmation that the notice about stored data was dismissed, the choice to switch the anonymous traffic measurement off, and the chat conversation identifier. Each of them is described in the Cookie policy: https://bdautomations.ro/cookie-uri.
For these values, Directive 2002/58/EC, transposed in Romania by Law 506/2004, requires no consent: they are strictly necessary for providing the service requested, or they are stored as a result of an express action by the visitor.

The assistant sends messages to Anthropic PBC only when it is configured with an API key. Without the key, the answers come from a set of answers written in advance, running on the company's own server, and the content of the conversation does not leave that server.
What is typed into the chat window reaches the model provider. Sensitive data, data about other people, card details and passwords must not be typed there.
The data may be disclosed to public authorities where a legal obligation requires it. Otherwise, one person has access to the database: the company's founder.
Transfers outside the European Union
The server, the database and the backups are located in the European Union. The content of the chat conversations is sent to Anthropic PBC, in the United States, when the assistant is configured with an API key. The public pages read for the demonstration on the company's website and the messages typed into the demonstration are likewise sent to Anthropic PBC, in the United States.
The transfer is based on the standard contractual clauses adopted by the European Commission and on the provider's own data processing terms. Where the email provider chosen processes data outside the European Union, the transfer rests on the same basis. A copy of these safeguards can be requested at bda@bdautomations.ro.
Retention periods
- Requests received through the form and conversations with the assistant: 24 months from the last contact. Deletion is automatic: the server checks daily and permanently removes whatever is past the term.
- The demonstration on the company's website: the request, 24 months from the last contact; the messages of the demonstration, until it expires, 24 hours after it is ready; the public data read from the company's website, 30 days, and the phone and email it publishes, copied into the internal list of businesses with the request, as long as the request.
- Server logs: for as long as the hosting provider keeps them, typically about 30 days.
- The anonymous traffic counters: indefinitely, since they are not personal data.
- Documents kept under a legal obligation: the periods set by law.
On request, the data is deleted before those periods expire, except for data the law requires to be kept.
Rights of the data subject
The data subject has the following rights:
- access: to obtain confirmation that the data is processed and a copy of it;
- rectification: to have inaccurate data corrected and incomplete data completed;
- erasure: to have the data removed where there is no legal reason to keep it;
- restriction: to have the processing suspended while an objection is checked;
- objection: to object to processing based on legitimate interest, including to the retention of the chat conversation;
- portability: to receive the data provided, in a structured, commonly used and machine-readable format.
Requests are sent to bda@bdautomations.ro and are answered within one month of receipt. For complex requests the period may be extended by two months, with the data subject informed, as article 12 GDPR provides. Exercising these rights is free of charge.
To avoid disclosing the data to someone else, the company may ask for confirmation of identity, for example by a reply from the email address used in the earlier correspondence.
The processing is not based on consent, so there is no consent to withdraw. The choices stored in the browser can be changed from the site at any time.
Complaints
Any complaint about the processing of data may be addressed to the company at bda@bdautomations.ro. The data subject has the right to lodge a complaint with the supervisory authority:

The data subject may also bring the matter before the competent courts.
Automated decisions and profiling
The company takes no decisions based solely on automated processing that produce legal effects on the data subject or similarly significantly affect them, and it carries out no profiling. The assistant produces answers with a language model, but it does not assess, score or reject people.
Children
The site is addressed to companies and the people who represent them. It is not intended for children under 16 and the company does not knowingly collect data about them. If a parent or legal guardian finds that a child has sent data, it is deleted on notice sent to bda@bdautomations.ro.
Security of the processing
The measures applied are the following:
- Traffic between the browser and the server is encrypted (HTTPS).
- The pages are served with a content security policy, and the typefaces are hosted on the company's own server, so visitors' requests do not reach an external font network.
- The back office is protected by a password and is not indexed by search engines.
- Only the fields needed to answer the request are collected.
- The IP address is kept only as a salted hash; the address itself is written nowhere.
- The form, the demonstration, the assistant and the page counter have usage limits, and the forms have a hidden field that stops automated submissions.
- The database is backed up.
- One person has access to the data: the company's founder.
The company holds no security certifications and invokes no standards it does not apply. No system is perfectly secure. A personal data breach is notified to the supervisory authority under article 33 GDPR, and data subjects are informed under article 34 where the breach presents a high risk to their rights.
Use of an artificial intelligence system
The assistant in the chat window is an artificial intelligence system, not a person, and its answers are generated automatically. Informing the visitor of this is required by Regulation (EU) 2024/1689, article 50, and is done in the assistant's first message, through this policy and through the Terms and conditions. The assistant of the demonstration on the company's website introduces itself the same way, as a virtual assistant, in its first message. Communication with a person is available at any time at bda@bdautomations.ro.
Changes to this policy
The applicable version is the one published on this page, with the date of the update shown below. An important change, such as a new recipient of the data, is flagged on the home page before it takes effect.
